RE: The tariff classification of fasteners from Taiwan and China.

Dear Mr. Green:

In your letter dated May 17, 2001, you requested a tariff classification ruling. Samples for the Wood Screws and the Hammer Drive Pins were provided with your request.

You have described your items as follows:

5/8 –11 x 2, Hex Cap Screws, Grade 2, Zinc Plated and made in China 12 x 2 Phillips Flat Head Wood Screws, Zinc Plated and made in Taiwan 1/4 x 1 Hammer Drive Pins made of 1062 Grade Carbon Steel and made in Taiwan. You stated that they are used with a powder-actuated handtool.

These items, which are all made of steel, will be sold to hardware stores for resale to their customers. Typical uses would be for home repair, construction, etc.

The applicable subheading for Hex Cap Screws will be 7318.15.8065, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: having shanks or threads with a diameter of 6 mm or more: other: other: with hexagonal heads: other. The duty rate will be 8.5% ad valorem.

The applicable subheading for the Phillips Flat Head Wood Screws will be 7318.12.0000, HTS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: other wood screws. The duty rate will be 12.5% ad valorem.

The applicable subheading for the Hammer Drive Pins will be 7317.00.2000, HTS, which provides for nails, tacks, drawing pins, corrugated nails, staples (other than those of heading 8305) and similar articles, of iron or steel, whether or not with heads of other material, but excluding such articles with heads of copper: other, suitable for use in powder-actuated handtools: not threaded. The duty rate will be free.

There are no quota or visa restrictions on these items at this time.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
